1. About These Terms

 

These Terms and Conditions govern your use of pixsouls.com and realty.pixsouls.com, and any photography or related services booked through these websites. By accessing our website or placing a booking, you agree to these terms in full. Our services are provided by Varun Kassana operating as PixSouls Photography, based in Oakville, Ontario, Canada.

If you do not agree with any part of these terms, please do not use our website or services.

2. Our Services

 

PixSouls Photography provides real estate photography and related services across the Greater Toronto Area, including but not limited to:

  • HDR interior and exterior photography

  • Drone and aerial photography

  • 3D virtual tours

  • Walkthrough video production

  • Floor plan creation

  • Virtual staging and virtual renovation

  • Twilight photography

  • Property websites and marketing materials

 

Service availability, pricing, and specific deliverables for each package are as described on our booking platform at the time of booking. We reserve the right to update our service offerings and pricing at any time without prior notice.

3. Bookings and Scheduling

 

All bookings are made through our online booking system at realty.pixsouls.com. A booking is confirmed once you receive a written confirmation from us by email.

When booking, you are responsible for ensuring that:

  • The property address and square footage provided are accurate

  • Access to the property is arranged and available at the scheduled time

  • The property is ready for photography at the time of the shoot

If the property is not accessible or ready at the scheduled time, a cancellation or rescheduling fee may apply as described in Section 5.

 

4. Payment

 

Payment is due at the time of booking unless otherwise agreed in writing. We accept payment through the methods available on our booking platform. All prices are listed in Canadian dollars and are subject to applicable taxes.

For larger or custom projects, a deposit may be required to secure the booking date, with the remaining balance due prior to or at the time of delivery.

We reserve the right to withhold delivery of completed photos and media until full payment has been received.

 

5. Cancellations and Rescheduling

We understand that circumstances change. Our cancellation and rescheduling policy is as follows:

  • Cancellations or rescheduling requests made more than 24 hours before the scheduled shoot will be accommodated at no charge.

  • Rescheduling requests made within 24 hours of the scheduled shoot will incur a fee of $50 value.

  • Cancellations made within 24 hours of the scheduled shoot, or where the photographer arrives and cannot access the property, will be charged in full.

6. Delivery of Photos and Media

 

We aim to deliver all completed photos and media within 24 hours of the shoot, unless a different timeframe has been agreed upon in writing. Delivery times may vary for larger packages, drone content, 3D tours, video, or floor plans.

Photos and media are delivered digitally via a download link sent to the email address provided at booking. It is your responsibility to download and back up your files within the timeframe specified in the delivery email. We are not responsible for files that are lost after the download link expires.

 

7. Copyright and Usage Rights

 

All photographs, videos, floor plans, and other media created by PixSouls Photography remain the intellectual property of Varun Kassana and PixSouls Photography.

Upon full payment, you are granted a non-exclusive, non-transferable licence to use the delivered media for the following purposes:

  • Listing the property on MLS and real estate portals

  • Sharing on your personal or business social media accounts

  • Including in your professional marketing materials

  • Sending to your clients in connection with the property listing

 

This licence does not permit you to:

  • Sell or sublicense the media to any third party

  • Use the media to promote any business other than the specific property listing it was created for

  • Remove or alter any watermarks or branding we have applied

  • Claim ownership or copyright over the media

 

PixSouls Photography reserves the right to use any images or media created under these terms in our own portfolio, website, social media, and marketing materials, unless you notify us in writing before the shoot that you require confidentiality.

 

8. Property Access and Safety

 

The client is responsible for ensuring safe access to the property at the time of the shoot. Our photographer has the right to refuse or cease a shoot if conditions at the property are deemed unsafe, including but not limited to unsafe structures, hazardous materials, or unsafe access routes. In such cases, the shoot will be treated as a cancellation within 24 hours and charged accordingly.

 

For drone shoots, the property must be within a legal drone flight zone under Transport Canada regulations. It is the client's responsibility to confirm this before booking. If a drone shoot cannot be completed due to restricted airspace or unsafe weather conditions, we will offer a rescheduled drone session or a refund of the drone portion of the booking.

 

9. Weather Policy

 

Interior photography is not affected by weather and will proceed as scheduled regardless of conditions.

Exterior photography, drone shoots, and twilight sessions may be affected by poor weather including heavy rain, snow, fog, or high winds. If weather conditions are unsuitable on the day of the shoot, we will do our best to capture usable exterior shots. If exterior or drone content cannot be completed, we will offer a follow-up session for those components at no additional charge, subject to scheduling availability.

 

10. Limitation of Liability

 

To the fullest extent permitted by applicable law, PixSouls Photography shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services or any failure to deliver within an expected timeframe, including loss of sale, loss of rental income, or any other financial loss connected to a property transaction.

Our total liability to you in connection with any booking shall not exceed the total amount paid by you for that specific booking.

 

11. Complaints and Disputes

 

If you are unsatisfied with our services, please contact us within 7 days of delivery at team@pixsouls.com. We will make every reasonable effort to address your concern, including offering a partial reshoot of specific areas if the issue is reasonably within our control.

We do not offer refunds based on subjective preferences regarding photographic style where our services have been delivered as described.

These Terms and Conditions are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes that cannot be resolved directly will be subject to the jurisdiction of the courts of Ontario.

 

12. Changes to These Terms

 

We reserve the right to update these Terms and Conditions at any time. The updated version will be posted on our website with a revised date. Continued use of our services after changes are posted constitutes your acceptance of the revised terms.
